Even though my purpose for seeing you yesterday was to see of the TSPC case materials you have been sent,  you were evasive, waiting til the end of our meeting--then "not being able to find the package".  Not a good way to rebuild trust.  WHY can't you find everything you've been sent from this corrupt organization about my license?  Do you see why I am asking for different representation?  You are either  a) not being truthful  or b) careless with my defense.  Either way is not comfortable.

The Stoller "Gifted" Program and the BSD Elite or "Hogue-talk"

Stoller is the middle school for the Oak Hills neighborhood. 'Nuff said. It was built to feed Westview, the high school that was built out-of-turn by Janet Hogue, the former parent/fundraiser (with an office in the BSD HR bldg.) who took her kid's drama to Scotland when the rest of the school was told to cut back. Hogue manipulated a dysfunctional school board that had hired Yvonne "Kickback" Katz as supt. and was running an obscene budget surplus. Hogue was made CEO of Beaverton's fundraising foundation by Katz and her secretive board. She served concurrently as overseer of Westview High (then Oregon's largest) site/building use committee.

Hogue's daughters, and the children of other influential people in the school community, had access to opportunities that were unavailable to other kids. Voicing that concern (among others about Westview's faltering leadership) to new supt Jerry Colonna would cost me my job and ultimately my career.

And, if the Stoller gifted program were moved to another school, people might find out that other kids from other neighborhoods were exceptional, too. They might get some of the awards. 

Some of those kids might demonstrate that they deserve parts in big-budget productions on Westview's multi-million dollar stage, given the chance.
 
That's why, so many years ago, I said to Colonna in a small group meeting, "She may have deserved the part" as I held up a school newspaper (they were scattered all over the room) and alluded to a photo of the younger Hogue daughter.  I was not criticizing the kid, but I had already experienced Janet Hogue's unethical abuse of power in the Beaverton School District while teaching her daughter in seventh grade language arts class.

Three weeks later I would be told I had been sexually harassing a librarian for three months. I would be told this by Hollis Lekas, former BSD HR official who had been Hogue's neighbor and the beneficiary (according to Lekas' husband Jim) of a large loan from the Hogues when Lekas' first husband had died. Ms. Lekas may or may not have been qualified to hire most of the administrators of Oregon's third largest district for two decades. We will never know that either--or why she was relieved of that responsibility by Colonna.  I can prove that she was sheltered by Hungerford Law and given the presidency of COSA after she sold me out. 

 I remain eager to have my record cleared of the subsequent four-year smear job to which former Oregonian writer David Anderson contributed. Careless and lazy journalism often contributes to corruption and fraud in gov't.  Oregon's schools have long needed a cleansing light. There are (several ) officials in state gov't who seem to think that federal money for disadvantaged kids is really THEIRS. I mean, who's checking really?  Until now.  

So when you print the BSD's communication expert's disingenuous rationale, "The principal didn't want to separate the kids," realize you are using "Hogue-talk" for protecting the privileged. 

 I hope "Hogue-talk" becomes a catch-phrase for schools that skimp on services the federal gov't desperately needs for them to provide to disadvantaged kids. According to Oregon's chief education double-dipper, Rob Saxton, the US gov't is about to sue those previously-unaccountable school leaders and bureaucrats who have been defrauding our national commonwealth (while they double-dipped in jobs they never had to do well, if at all). Stealing from other state's taxpayers.
 
"She may have deserved the part." The truth in that statement (Jan 2004) to Jerry Colonna is evidenced by the amount of (public education) money that was spent to demonize and silence me after I uttered it.  I am evidence that teachers who stand up to dysfunctions in the system are chattel.  The OEA is a racket that fleeces Oregon's teachers to prop up unethical politicians, a corrupt "teachers" union that serves, ominously, as a conduit to state gov't leadership for a lot of self-interested "educators."  
 
Good luck with your very important coverage of Oregon's opaque school administrations.

Just sent this message to Joanne Yatvin, an education mentor whose blog I get.  I have forwarded to her a note I just emailed to Betsy Hammond of The Oregonian.  I feel the juxtaposition of these two messages--both very recent--distills my frustrations about inequities and lack of accountability in public schools and briefly explains my conflicts with people who perpetuated those inequities.  Hope you are making progress with my mission to remove my unlawful suspension from the state website.

START of letter to Dr. Yatvin:

  I just sent the following to Betsy Hammond.  Yes, I am obsessed.  This is unfinished business for me and I cannot really engage in another project until I have some closure.
   But it speaks to a bigger issue.  A lot of the people who covered up my abuse now enjoy big jobs in education. I am driven to expose them. We will have to do this more frequently as a nation to restore a functional democratic government, but I believe strongly that it happens at a local level first.
   I can't get into your essays because my basic rights were stripped by a system you espouse. Teaching is really about the people who do it. and the ones who do it well are all unique and disparate.    Everywhere I went, I was high-energy and innovative and those qualities frequently alienated me from the sedentary types who inhabit every school.
   I've gone to war with "insiders" to some degree everywhere I worked...for the right reasons. In Beaverton, where so much of what I encountered was rooted in cronyism, I was chattel.  I got fired for four years after asking to quit and the  record reads that I'm a sex perp. My mother, a classroom teacher for 35 years, died watching me get smeared in the news while fighting a "teachers" union that I paid for a decade.
  So when you write about behavior and special classroom skills, realize that I see you as a merchant of propaganda. The years I spent with deaf kids in residential schools, trained extensively in behavioral management techniques by the staff from Boystown in Nebraska, went unrewarded in my BSD pay, but I was the guy in the state's largest public school who got the troubled kids.  The IT lady came to my media class one day and absently commented that "my kids" were known as thieves.  I reminded her that "my kids" were "our kids" whom others didn't wan to teach. My innovative classroom techniques were designed to give "facetime" to under-served kids and often alienated the kids (and parents) who expected to get the "lead" every time. Usually I engender enough good will through my hard work and genuine effort to give everyone starring roles (to this end, we started creating our own scripts : )--but I received no such protection in Beaverton because my antagonists were connected to the corrupt process that occurs in the overlap between the union and state gov't.
Do you recall Thoreau's response when Emerson went to visit his student in the local jail, where he had been put for an evening because he had refused to pay his taxes, protesting the actions of the federal gov't (busy at the time "acquiring" Texas from Mexico and supporting slavery). "Henry, why are you in jail?" Emerson is reputed to have asked his student, to which Thoreau retorted, "Professor Emerson, why are you not?" My point would be too cryptic for some audiences but is not lost on you, I know.  I will risk redundancy by waxing poetic: You are writing about flowers sprouting heroically in a barren, infertile field. There soil has been stripped through neglect and decay and the real work to be done is systemic and over-arching.  It begins at the top and it begins with honest recognition and personal responsibility.
It's personal for me.  But when you write about what makes goods schools, you do a real disservice to those of us who really worked hard in the Oregon system and stood up for our students and our profession.

 Chattel.

 Without accountability and oversight of school administrators, everything you write so skillfully about is a mere distraction.

I appreciated your recent report on Oregon's test obstructionists. Thank you for referring to the corrupt union that runs Oregon state gov't as the "OEA" and not the "teachers union," as is often your preference. Teachers only pay the salaries and operational costs. Crystal Greene (another professional communicator) and the guy who moved from union leadership to state gov't from the OEA's "Center for Great Schools" (really?!?)...what was his name? Both OEA veterans...? Seems like the overlap of the state's education dept. and the influential union deserves some light.

Screams for light. 

Lot of money in public education...especially special education.  Oh, that's right. Oregon's special ed funding funnels through "regional education service districts." (I know about those.  My erstwhile employment "hearing"--the one that cost me my career--happened in one. 

But Betsy, you have been too busy fomenting anger among polarized, frustrated taxpayers and parents to write about the FDAB, huh? Like standardized tests are really what will a) radically improve b) destroy schools.

Click bait.

Does your organization have reporters who are interested when courts are operated extra-legally, as mine was?

The OEA, beneath the sappy slogans and sophomoric propaganda, is a teacher-subsidized racket whose corrupt leaders have surely done more than any other individuals to diminish the potential in Oregon's schools. How they have avoided media scrutiny is a question you will have to answer one day.

Leaders of the "teachers" union are surely disproportionately responsible for Oregon's dysfunctional school administration. It is not lack of funding that diminishes Oregon's schools; it is greed. You and many of your colleagues are blatantly remiss in your journalistic responsibilities to continue to ignore systemic, well-established corruption in education in Oregon. 

The Oregonian, by allowing our education leaders to maintain mantles of respectability they do not deserve while misleading and misrepresenting the taxpayers, owns some of the damage.

The OEA should have a Center for Union Officials and State Bureaucrats Who Enjoy Zero Oversight and Accountability. That's the kind of place the Department of Education can recruit new staff members. 

Finally, Betsy, it would plain piss me off if I were writing about important education matters and a few not particularly clever or honest people (Crystal Greene? Sue Robertson??? Hanna Vaandering???????) used me to gull the public. 

 Aren't you angry yet?

1. My building principal was caught coming to work drunk and given a secrecy agreement and a silence pay off (and a job in Skamania County, Washington). He had paid me $20K less to be Westview High activities director that he did my successor and I complained.

2. The asst. principal who had been trying to force me to change students' grades convinced a librarian who worked for her to sign a document with three contrived sexual harassment charges.

3. Another assistant principal (now on the BSD administration) had been my supervisor for less than four months when he helped to lock me out of the building, then told parents I had refused to turn in grades and had intentionally sabotaged college admissions and scholarships.

4. I was working 70-hr weeks in both humanities and technology, often in two languages, working with kids whom others did not wish to teach.

 5. My union sold me out. My union rep met with the BSD HR directors and planned my termination.  The Beaverton union president, Hanna Vaandering, brought me an illegal SECOND settlement contract to a bogus "million-dollar" federal law sit for freedom of speech (filed by my OEA lawyer w/o consulting me) after the federal judge had been told my case was settled.

6. The TSPC director, hired by the man I was "suing," (Jerry Colonna), harassed me for almost four years to sing a ever-changing array of stipulations that were effectively confessions to charges that were never documented or testified to. 

7. I said, "She may have deserved the part," about the daughter of the BSD's fundraising arm, the BEF. Her daughter's drama club had just come back from a trip to Europe after the rest of us had been told to cut back due to budget restraints.  My concern was about inequities.

8. Same fundraiser had her daughter removed from my seventh grade language arts class in mid-year when I taught her at Meadow Park. No meeting. No documentation.  Kid just came to class one day and announced she didn't have to be there any more. Started going to the technology room during my class time and doing online stuff with the University of Stanford. I received no explanation.

 My OEA representative sat on the board of directors of the BEF.

Dear Oregonian staff,
I was forced to give up a career as a teacher in part because of lack of professionalism displayed by The Oregonian staff assigned to cover the violation of my employment contract in 2004--and the subsequent public smearing by the BSD's unethical former law firm, Hungerford, AKA "attorneys for many Oregon school districts" (dishonest lawyers who have successfully manipulated state agencies and courts on behalf of deep-pocketed public school administrators for many years).
 
In 2004, the principal of the state's largest high school was coming to work drunk, among other unprofessional conduct, and The Oregonian helped cover that up. That I was fired by him for obviously contrived sexual harassment charges (later thrown out) was obscured by the fact that an Oregonian reporter wrote about a "finding" at a hearing--an undocumented allegation from the distant past that I had tried to talk a 12-year-old into my truck cab during class time...six years before I was fired for false (blatantly contrived) sexual harassment charges.  The Oregonian reporter didn't have the time to talk to me, or to write that the finding was without ANY documentation or testimony and had just been alluded to by the collaborating lawyers. The Oregonian writer didn't have time to write about why I was really fired, or why I was complaining about inequities in the state's largest high school.  He didn't have time to write that my OEA lawyer had filed a "million-dollar" lawsuit in federal court without consulting me, BEFORE my FDAB "hearing," and used the federal case to silence and manipulate me for almost four years.  The Oregonian didn't have time to write about the only black teacher at the state's largest high school being run off by an insensitive, dishonest asst. principal...the same asst. principal who solicited sexual harassment charges when I stood up to her for trying to influence my grades.  The same asst. principal who ran off a deaf teacher...a GOOD deaf teacher.
 
Didn't have time.  Busy beat, the West side.
 
Easier for The Oregonian writer to write what the school PR hack gave him (Dave Anderson would make a good administrator in Oregon schools--he has the right ethical qualifications).
 
I have been trying to clear my name of the smear job that was done  to punish me after I told the new superintendent that "she may have deserved the part," about the daughter of the district's fund raiser.  Her drama group had just been to Scotland when the rest of us had been told to cut our budgets.  That is the REAL reason I was fired for sexual harassment.
 
At what point will your paper publish the truth, or even care about it? I remain eager to clear my name and explain to the stakeholders what happens when someone tries to blow the whistle on those "respectable" people in education leadership who have been abusing their authority and deceiving the  Oregon public for many, many years.
 
Finally, the article that Anderson "wrote" about the FDAB findings was the last thing my mother read about me before she died. I remain eager to clear my name of the smear job to which The Oregonian unprofessionally contributed.

An appeals board has rejected the case of a Westview High School teacher who claims he was fired because he raised concerns about favoritism toward wealthy students.

The Oregon Fair Dismissal Appeals Board ruled that Donald Bellairs was insubordinate and neglected his duties as a teacher. The board also concluded that Bellairs had engaged in "a pattern of angry and disrespectful outbursts, as well as other unprofessional and disruptive communications, towards students, parents, staff and administrators."
Bellairs plans to appeal the ruling to the Oregon Court of Appeals, said his lawyer, Thomas Doyle. The appeals board improperly used past incidents involving Bellairs to judge whether he was insubordinate and had neglected his duties during the past school year, Doyle said.

The appeals board supported Bellairs' claim that he did not sexually harass another staff member at the school. That was one of three reasons the Beaverton School Board fired Bellairs in February, according to the appeals board's analysis.

But the board found that Bellairs was insubordinate during a teachers' meeting with Superintendent Jerry Colonna in January. Bellairs complained about a student who had been given the lead in a drama production, saying it was because her parents were active in the school and donated money to the drama program. Bellairs, who had a history of conflict with the girl and her parents, spoke in a disrespectful manner, the appeals board found.

And Bellairs neglected his duty by failing to complete grades for students in January after he was placed on administrative leave.

School district officials said they were limited in what they could say, because Bellairs is continuing to appeal the case. But Linda Borquist, an associate superintendent for human resources, said the outcome confirms the district's actions.

"About all I can say is that we're glad there's a process to review our practices and procedures to make sure we treat our employees fairly," she said.

It was the first time in Borquist's 12 years in the district's human resources department that a teacher has taken a firing to the appeals board. The two sides conducted a three-day hearing before the three-member panel in June. The board made its decision late last month.

Bellairs has filed a $1 million federal lawsuit against the Beaverton School District, claiming the district violated his First Amendment rights, defamed him and interfered with his ability to get a home mortgage. He is seeking compensation for severe emotional and physical injury, plus lost wages, punitive damages and attorney's fees.

Both sides claimed that the appeals board decision helped their case in the lawsuit.

Doyle said that the ruling actually helps Bellairs' case, because the appeals board rejected the sexual harassment grounds and not all the board members agreed that the grades issue was grounds for firing.

"We feel this case supports our federal complaint," Doyle said.

The district hired Bellairs, 51, in fall 1997 to work at Meadow Park Middle School. He transferred to Westview High in September 1999, where he taught media studies, keyboarding and English.

The appeals board's 24-page order reveals new facts about the district's reasons for firing Bellairs. It describes a history of incidents going back to his time at Meadow Park. They include:

* An accusation that Bellairs took a female student at Meadow Park into his pickup in the school parking lot and belittled her, using inappropriate language.

* A confrontation at Westview High after a staff member changed computer passwords without telling Bellairs. Bellairs was accused of angrily confronting the staff member and a vice principal. Other staff members who witnessed the outburst said they were frightened.

* An ongoing dispute that started over video equipment between Bellairs and a student and his parents. After the student returned a camera a day late, Bellairs said the boy couldn't use equipment for the remainder of the year. The boy's father asked for the decision to be reversed. After a series of meetings, which included one that left the student in tears, administrators placed a memo in Bellairs' file directing him to treat other employees and students with respect.

* An accusation by a female staff member that Bellairs hugged her and made suggestive comments that made her uncomfortable. The woman said she didn't say anything to Bellairs because she was afraid of his angry outbursts. Although the appeals board found that Bellairs' actions didn't amount to sexual harassment, they said it was further evidence of the effects of his outbursts.

BEAVERTON -- Beaverton School District administrators will begin a search in January to replace Westview High School Principal Malcolm Dennis, who unexpectedly resigned late last month.
Gail VanGorder, a retired vice principal at the 2,300-student school, came out of retirement last week to serve as Dennis' temporary replacement.
With Dennis' departure, the Beaverton School District has first-year principals leading six of its seven high schools. Carl Mead, Sunset High School principal, is in his second year at the school.
Dennis, who cited health reasons when he left the school Oct. 27, could not be reached for comment.
Maureen Wheeler, a district spokeswoman, offered no specifics concerning his departure.
Students learned of Dennis' resignation from administrators at a special assembly Oct. 28.
VanGorder said Superintendent Jerry Colonna offered her the interim job on Oct. 27. VanGorder retired in July after nine years as vice principal at Westview, the state's second-largest high school.
VanGorder, who began at the school Nov. 3, said she was surprised and excited by the opportunity.
"I've always felt very close to the Westview community, so it's not hard for me to return there," she said.
She has been working hard to get to know the school's 25 new teachers and learn the faces of hundreds of freshmen.
A principal could be hired midyear, but contracts typically take effect July 1. Desirable candidates may not want to leave their jobs before the end of the school year, Wheeler said.
VanGorder said she hasn't ruled out staying on permanently.
"That's a possibility, but it's way too early for me to tell," she said. "I do know Mr. Colonna is committed to moving forward with a comprehensive search."
The 58-year-old educator began her career in the Beaverton district as a library aide at Meadow Park Middle School. She worked as a librarian at Beaverton schools for two decades before taking her first administrative position as a vice principal at Merlo High School in 1993, the year it opened.
She moved to Westview as a vice principal in 1995.
